Terms of service
SIA Your Point, Reg. No. 40203682079 , Mārupes District, Mārupe, Pētera Street 2, LV-2167 , hereinafter – the online shop – provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.
1. General Provisions
When a consumer purchases goods/services via the website, such a mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia governing distance contracts, including but not limited to the “Consumer Rights Protection Law” of the Republic of Latvia, the Cabinet of Ministers regulations “Regulations on Distance Contracts”, and others.
2. Making Purchases
The prices and specifications of the products sold in the online shop are indicated next to the products.
To place an order, add your desired products to the shopping cart. Fill in all the required fields and select the most suitable delivery method. The total cost of the order including delivery will then be displayed on the screen. Complete the payment to finalize the order.
3. Payment Terms
The currency for transactions on the site is euro. Purchases can be paid for by selecting the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
- Latvian internet bank payments: Swedbank, SEB, Citadele and Luminor
- Estonian internet bank payments: Swedbank, SEB, Luminor
- Lithuanian internet bank payments: Swedbank, SEB and Luminor
- Revolut, Paysera payments
- Visa/Mastercard card payments
- Apple Pay and Google Pay payments
NB! When using the internet bank payment method, confirm your order and click the “Return to merchant” button.
Personal data required for payment are transferred to the licensed payment institution Maksekeskus AS.
The contract takes effect upon successful payment to the online shop’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed and the paid amount will be refunded as soon as possible, but no later than 14 days after receiving the notification.
4. Delivery Terms
Goods are delivered to the following countries: Latvia, Lithuania, Estonia. Purchased goods are delivered via parcel delivery partners or courier services DPD, Omniva, Venipak, Unisend. All charges and taxes required to receive the shipment at the delivery destination must be borne by the Buyer. Delivery costs are displayed before confirming the order. Purchased goods are delivered to the address specified by the Buyer within 3-5 working days. In exceptional cases, we reserve the right to ship goods within up to 45 calendar days, notifying the customer accordingly.
5. Right of Withdrawal
The Buyer has the right to withdraw from the goods within 14 calendar days from the moment of receiving the goods. (Depending on the product, the buyer may not have mandatory right of withdrawal; in such a case, the reason must be clearly stated and explained.) The right of withdrawal does not apply if the Buyer is a legal entity.
To exercise the 14-day right of withdrawal, goods may only be used for their intended purpose, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If goods are used inappropriately or damaged, handled carelessly during use, instructions are not followed, the original packaging is lost, or the packaging is significantly damaged, the online shop has the right to reduce the refundable amount in proportion to the reduction in the value of the goods.
To exercise the right of withdrawal, you must submit a withdrawal application by sending it to the email address info@yourpoint.lv within 14 days after receiving the goods.
The Buyer must return the goods to the Seller without delay, but no later than 14 days after sending the withdrawal application to the online shop. After receiving the returned goods, the online shop will promptly, but no later than 14 days, refund all payments received from the buyer under the Distance Contract.
The Seller has the right to withhold payment until they have received the goods from the Buyer or proof of return of the goods. If the buyer has chosen a delivery method other than the cheapest delivery method offered by the online shop, the shop is not obliged to reimburse the excess delivery costs.
The online shop is not responsible for delays or failure to fulfil obligations or any other non-fulfilment caused by circumstances and obstacles beyond the reasonable control of the online shop.
The online shop reserves the right to refuse to sell goods and to require the return of goods from the Buyer if the price indicated in the online shop is significantly lower than its market price due to an error.
6. Consumer rights regarding non-conforming goods
The online shop is responsible for any non-conformity or defects in goods sold to the Buyer which arise within 6 months from the date of delivery to the client, or which existed at the time of delivery, unless such assumption is inconsistent with the nature of the goods or the defect. The Buyer must inform the Seller of the non-conformity of the goods immediately, within 15 days of discovering it, i.e., by submitting a complaint. The Buyer may submit a complaint by contacting the online shop in writing at info@yourpoint.lv
The online shop is not responsible for defects that occur after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer is entitled to request the elimination of the defects or exchange the goods for new ones free of charge.
If the goods cannot be repaired or replaced, the Seller will return to the Buyer all payments provided for in the Distance Contract. The Seller will provide a written response to the consumer’s complaint within 15 days.
7. Processing of Buyer’s Personal Data
The online shop processes only the personal data that the buyer has entered when ordering goods, such as name, surname, email, etc.
The online shop transfers personal data to the transport service provider(s) to ensure delivery of the goods.
If you have explicitly agreed to receive our marketing communications, including newsletters, we may from time to time contact you by sending information about our services and latest offers. For this purpose, we may process your email address, which you provided when subscribing to marketing communication. The Buyer may opt out of marketing messages by notifying us in writing at info@yourpoint.lv
8. Dispute Resolution Procedure
In matters not regulated by these terms and conditions, the Buyer and Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.
The Parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If it is not possible to resolve the dispute through negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, in accordance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
The Buyer also has the right to apply to the European Union dispute resolution institutions.
